Durga Prasai arrested in electronic business

 Durga Prasai, a medical professional from Jhapa, was arrested by the Cyber ​​Bureau of Nepal Police from Bhaktapur on Sunday.


Four days after obtaining the arrest warrant from the Kathmandu District Court, the police arrested him from his house at Kamerotar, Madhyapur Thimi Municipality-6, Bhaktapur on Sunday.





Jeevan Pandey of Baglung and Prakashchandra Dahal of Dhading, two YouTubers who were allowed to be arrested by the court along with Prasai, have not been arrested.


Bureau SP and spokesperson Deepak Raj Awasthi said that Prasai, who was arrested from Bhaktapur, was brought to Veer Hospital for medical examination. After the medical examination, the police is preparing to take permission from the court to detain him on Sunday.





According to SP Awasthi, a leader of RSVP had filed a complaint against them. After hurling personal insults at her, the leader reached the cyber bureau of the police.


The bureau is preparing to proceed with the investigation and action process against the arrested Prasai according to Section 47 of the Electronic Transactions Act 2063.


During the preliminary investigation so far, it seems that Section 47 will be attracted against him. If something more is discovered during the investigation, the process will proceed accordingly," said SP Awasthi.


Section 47 mentions the action to be taken against the publication of illegal content in electronic form.


'Publishing or displaying materials that are prohibited by the prevailing laws on computer, Internet and other electronic communication media, or materials against public morality, etiquette, or materials that spread hatred or malice towards anyone, or disrupt harmonious relations between different castes, castes, and sects, tease women. , a person who harasses, insults or commits any other such unrestricted act or causes to be committed shall be punished with a fine up to one lakh rupees or imprisonment for a term up to five years or both" is mentioned in Section 47.


According to sub-section 2 of 47, if this offense is committed repeatedly, the punishment will be double the previous punishment for such offence.


With the arrest of Prasai, the way has been opened for the police to investigate him by keeping him in custody for 25 days. After the investigation is over, the police will submit the investigation report to the district attorney's office. After that, the Public Prosecutor's Office will file a case against him in the Kathmandu District Court.


After the completion of this process, he can be released on simple bail or bond and sent to jail for pre-trial detention. If found guilty, Prasai can be imprisoned for up to five years.
